Start Standard Probate/Letters Application

Simple to-do list

  1. Transfer $1,432.00 to our trust account
  2. Send us a copy of the death certificate and any will or other evidence of last wishes
  3. Book an appointment to meet with our specialist
  4. Reply to emails and complete the questionnaire we send you
  5. Understand that if this is a complex-high risk application, this standard service may not be suitable.

1. Transferring money to our trust account

Payment of $1,432.00 is the minimum required in advance, but we recommend you let us pay for the advertising and court fees on behalf of the estate, so it is easier to transfer $2,316.30 one-off upfront to cover those outlays too. Please remit funds to –

Robert J Garvey Solicitor Trust Account
ANZ Bank 324 Queen St Brisbane
Branch (BSB) no. 014 002
Account no. 4977 71221
Swift code: ANZ BAU3M (if needed)

Be warned: computer hackers are known to impersonate lawyers to fraudulently intercept EFT payments. So you might want to telephone us or otherwise independently verify those account numbers. More importantly, if ever you are transferring a large amount (e.g. over $10,000) definitely do not act on any Internet-based electronic communication (e.g. e-mail or webpage) that asks you to transfer or deposit money without independent verification to check for authenticity.

2. Sending us a copy of the will and death certificate

You can send this by –

Caution: handle the original will with care! To avoid unnecessary requisitions from the probate court, do not damage, clip or dent the original will and please keep it in a protective sleeve.

3. The appointment

Book the appointment by contacting our office or using the online appointment maker. Allow 45-60 minutes of your time.

4. Emails and questionnaires

To use this standard service you must have an e-mail address that is private and appropriate for us to use for correspondence with you. We will send you questions and your answers will form the basis of your sworn application to court. If possible, please give us your responses before your appointment.

5. Understanding suitability

This standard service is designed to be suitable for the vast majority of deceased estates in Queensland with an ‘everyday’ service standard. This package may not be appropriate for high demand, risky or complicated probate applications. If you would prefer our highest level of service and attention to your probate matter, or the circumstances are deemed by us to be unsuited to this standard service, we can instead offer a higher level of service (complex) or your money back. The price of $1,432 is actually a firm estimate based upon a standard retainer and the absence of exceptional factual parameters, and like all our work, is subject to our general terms.
