Complex probate legal service for $2,198.00 (inc GST)

The third party outlays for probate (the same for all) currently total $897.30 and comprise:

  1. Supreme Court of Qld filing fee of $735.60; and
  2. Qld Law Reporter advertising fee of $161.70.

The total service cost to the estate is $3,095.30 inclusive of all outlays and GST.

This service is suitable for all common form grants of probate in Queensland because an experienced probate practitioner will –

  • prioritise service and professional attention to resolve complex attributes of the application
  • meet with the executor-applicant(s) in person and/or by telephone conference and e-mail to take in-depth instructions
  • advise on the resolution of complex probate issues that impede grants of probate or result in unsatisfactory grants.
  • advise on complicated estate issues including insolvency and conflicts of interest
  • search public information about the deceased and executors to identify estate issues
  • prepare the public notice of intention to apply for probate (including the notice to clearing creditors)
  • arrange and pay for due publication and service of the notice with the Queensland Law Reporter and Public Trustee
  • prepare and execute an affidavit of publication of service
  • prepare an affidavit for signing by the applicant-executor(s) including endorsement as many exhibits as might be needed
  • attend on applicant-executor(s) to witness their signing or express post to applicant-executor(s) for signing conveniently close to them (with a return pre-paid registered envelope)
  • Check and file all materials with the court and pay the court filing fee
  • Solicitor trust accounting for outlays
  • Answer probate requisitions including advice on and preparation of all requisitioned affidavit material
  • Report on the outcome of the application
  • Send certified copies of the grant of probate directly to all waiting parties requiring it.
